Abstract

This article aims to examine the issue of acquisitive prescription of agricultural property by foreigners in light of the applicable legal framework. Acquisitive prescription is a classical civil law instrument that enables the acquisition of ownership through long-term possession and plays a significant stabilizing role within the legal system. However, in the case of agricultural real estate, this institution is subject to numerous restrictions stemming from public law provisions aimed at protecting the national land market (or: national land resources). The analysis focuses on the relationship between the provisions of the Civil Code and the regulations contained in the Act on the Acquisition of Real Estate by Foreigners and the Act on Shaping the Agricultural System. Particular attention has been paid to the question of the extent to which these restrictions affect the possibility for foreigners to acquire ownership rights through acquisitive prescription, as well as the consequences this has for the certainty and stability of property relations in the agricultural real estate market, as well as the overall dynamics of property acquisition, especially of land intended for agricultural use.
