Abstrakt

At the time of its enactment, the Act on the structuring of the agricultural system already raised concerns about its form and contents. Numerous and, at the same time, confined amendments gave shape to the current version of the Act, which is far from the standards of fair legislation. The vague way in which the terms fundamental to the Act are defined has led to interpretational doubts. UKUR was chaotic in form, but also required clarifications to be issued, such as the Common Position of entities applying the Act or statements on the Government’s websites explaining the rationale be- hind the Act. The very central definition of an agricultural property has become the subject of much controversy, also being amended multiple times. These problems are important because the rationing that the UKUR introduces, i.e. strong restrictions on the property rights of the owner, should be proportional and sufficiently justified. The Act is unintuitive both with regard to basic issues, including internal roads, pre-emption of shares and stocks, excessive concentration of agricultural real estate, as well as more technical ones such as the circle of persons related to the seller or the obligation of running the farm personally. This paper will present the current problems of this regulation and propose possible solutions.
